TRADE MARK INFORMATION

Trade mark registration is governed under the Trade Marks Act (CAP 506) Laws of Kenya.

 

In Kenya, an individual, a company, a partnership, a society, a co-operative or any lawful association can apply for a trademark provided they meet the requirements of the Trade Marks Act. Foreign filings (persons without a Kenyan business address) for trade marks can only be filed through a trade mark agent such as Muthoni Advocates.

Kenya  trade mark law requires that a proposed trademark sought to be registered must be in respect of classes of goods or services. Kenya adopts the multi class system of filing trade marks and refers to NICE classification,10th edition in terms of the classification of goods and services. When accepted, the trade mark is advertised in the KIPI Journal (published monthly) for an opposition period of 2 months. If no opposition is lodged the trade mark application is granted and Registered.

 

Trade Marks in Kenya are valid for 10 years and renewable at least 6 months prior to their expiry.

  1. Simply signed Power of Attorney. 

  2. Details of trade mark and specification of goods and service.
